Cheervt respects the intellectual property and copyright rights of creators, artists, photographers, brands, and all third-party rights holders. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, Cheervt has adopted the following policy for responding to notices of alleged copyright infringement.

1. Copyright Ownership & Rights

All content available on https://cheervt.com (the “Website”), including but not limited to product photography, artwork, graphic elements, text, layouts, designs, logos, and other creative materials, is protected by U.S. copyright law and international copyright treaties.

Ownership of such content belongs to Cheervt or to third-party licensors who have granted rights to Cheervt. Unauthorized reproduction, distribution, modification, or public display is prohibited except as permitted by law or written consent.

2. Reporting Copyright Infringement (DMCA Notice)

If you believe your copyrighted work has been reproduced, displayed, or distributed on our Website in a manner that constitutes copyright infringement, you may submit a formal DMCA notice to request removal.

Your DMCA notice must include the following elements, as required by law:

  • Identification of the copyrighted work (description of the work allegedly infringed)
  • Identification of the infringing material (URLs, product links, or exact references)
  • Contact Information of the complaining party (full name, address, email, phone)
  • A statement of good-faith belief that the material is not authorized by the rights holder, its agent, or the law
  • A statement of accuracy and authority confirming authorization to act on behalf of the copyright owner
  • A physical or electronic signature

Failure to provide the above information may delay or invalidate the DMCA request.

Upon receipt of a compliant DMCA notice, Cheervt will review the claim and take appropriate action, including removal or disabling access to the material in question.

3. Counter-Notification (Response to Removal)

If content has been removed due to a DMCA notice and you believe the removal was in error or unauthorized, you may submit a DMCA counter-notification including:

  • Identification of the material removed
  • Location of the material before removal
  • Statement under penalty of perjury that the removal was wrongful or authorized
  • Consent to jurisdiction of a U.S. Federal District Court
  • Contact information for legal correspondence
  • A physical or electronic signature

Counter-notices must be sent to the same contact information provided above.

If a proper counter-notice is received, Cheervt may reinstate the removed material unless the claimant initiates legal action within the timeframe required by law.

4. Repeat Infringer Policy

In compliance with the DMCA, Cheervt reserves the right to restrict access, terminate accounts, or remove listings from users who repeatedly infringe copyright rights.

5. Misuse of DMCA Procedures

Submitting fraudulent or bad-faith DMCA notices or counter-notices is prohibited and may result in legal liability, including damages, fees, and penalties.

6. Third-Party Content & External Links

Cheervt may display or link to third-party content. We are not responsible for external platforms and cannot guarantee control over such content. Rights holders must direct separate claims to the applicable third parties.

7. Reservation of Rights

Cheervt retains all rights to legal remedies and defenses under the DMCA and applicable copyright laws. This policy does not limit or waive rights under any jurisdiction or treaty.
